With the entry into force of the new Whistleblower Protection Act (HinSchG) in 2023, Germany has implemented the EU Whistleblower Directive.
The aim of the HinSchG is to protect persons who have obtained information about breaches of statutory provisions and regulations in the course of their professional activities and report them. The HinSchG prohibits any reprisals against whistleblowers and obliges companies to set up secure channels for whistleblowing.
External lawyer as ombudswoman
In order to provide whistleblowers with the best possible protection, Müller-Boré has appointed an external lawyer as an ombudswoman and internal reporting centre within the meaning of the Whistleblower Protection Act in the course of combating violations of statutory provisions and regulations.
The ombudswoman, Dr Kathrin J. Niewiarra, is available as a contact person for all whistleblowers who wish to provide confidential or anonymous information about irregularities at Müller-Boré or in connection with Müller-Boré's business activities. The information must be in connection with their professional activity or in advance of a professional activity at Müller-Boré.
Submission of information in accordance with the HinSchG
Information on grievances in connection with Müller-Boré within the meaning of the HinSchG can be submitted under confidentiality via the electronic whistleblower system (HGS) of Dr Niewiarra, accessible via the following link:

What happens after a report is submitted
Dr Niewiarra examines the information received and carries out an initial legal assessment.
With the express consent of the whistleblower (also and especially with regard to his/her identity), this will be forwarded to the Compliance Officer at Müller-Boré for further examination of the matter. Absolutely confidential treatment of the information is guaranteed.
If the information can be substantiated, further measures will be initiated. If the information proves to be irrelevant, the investigation will be terminated.
In addition, all personal data will be deleted in accordance with data protection regulations.
