The 17^th draft of the Rules of Procedure for the Unified Patent Court is now available at the homepage of the Unified Patent Court (www.unified-patent-court.org) and can be downloaded here:

The version of the draft available at the homepage of the Unified Patent Court reflects the amendments made by the Expert Group of the Preparatory Committee of the Unified Patent Court (in red) as a result of the written consultation and the amendments made by the Legal Group of the Preparatory Committee (in blue). 

 

The recent draft of the Rules of Procedure for the Unified Patent Court is expected to be the last draft. It is expected that the Rules of Procedure will be finished by February 2015. One of the major amendments of the 17^th draft which is now under discussion concerns the handling of a situation where a counterclaim for revocation has been referred to the central division while the infringement action is being dealt with by a local or regional division. Further amendments concern exceptions to the language regimens laid down in the Unified Patent Court Agreement. There will be an oral hearing held on this draft on November 26, 2014 at the European Law Academy (ERA) in Trier from 9:00 a.m. to 6:00 p.m. CET. During this oral hearing more than 70 organizations as well as a group of experienced patent judges will discuss this draft. In order to allow the public to follow the discussion a live webcast will be available and it can be accessed on the website of the European Law Academy under www.era.int.
